Dieselgate : Daimler passe à la caisse
Après Volkswagen, c’est au tour de Daimler. Le constructeur automobile allemand a négocié avec les autorités américaines une sortie du Dieselgate. Si le montent convenu risque d’affecter le free cash-flow du groupe, il était important de faire un pas vers la sécurité juridique.

Dans le cadre du scandale des émissions truquées des moteurs diesel qui avait d'abord concerné Volkswagen, le constructeur allemand Daimler a conclu à son tour avec les autorités américaines un accord amiable d’un coût total de 2,3 milliards de dollars. Un pas important vient donc d'être franchi, sans pour autant garantir la fin de toute procédure concernant le scandale, de portée internationale.
L’accord de principe a été conclu avec 5 autorités américaines, pour régler les réclamations civiles et environnementales concernant les systèmes de contrôle des émissions de près de 250 000 voitures particulières et camionnettes diesel aux États-Unis. Les autorités américaines concernées sont l'Agence de protection de l'environnement (EPA), le California Air Resources Board (CARB), la division de l'Environnement et des ressources naturelles du ministère américain de la Justice (DOJ), le bureau du procureur général de Californie et le service des douanes et de la protection des frontières des États-Unis.
Concernant les règlements avec ces autorités, Daimler prévoit des coûts d'environ 1,5 milliard de dollars, ainsi qu’une enveloppe de 700 millions pour régler les plaintes collectives et les frais de justice et d'avocats. Par ailleurs, le constructeur estime à environ 500 millions d'euros les coûts supplémentaires liés à la mise en oeuvre des accords, sans fournir davantage de précisions - à titre de comparaison, Volkswagen avait dû modifier certaines de ses procédures internes, ce qui avait engendré des coûts supplémentaires. Au total, Daimler s'attend donc à débourser jusqu'à 2,36 milliards d'euros pour ses litiges américains. Il s'attend à un impact conséquent sur le free cash-flow de ses activités industrielles au cours des trois prochaines années, l’essentiel se produisant dans les douze prochains mois.
Le groupe s’était préparé à cet éventuel accord, puisque fin 2019, il avait provisionné 5 milliards d'euros pour faire face à ses risques juridiques dans le monde sur le scandale en question. Les accords sur la partie américaine du scandale ne signifie pas nécessairement la fin des litiges liés au Dieselgate pour Daimler. À titre de comparaison, pour Volkswagen, le cout total du scandale en mars 2020 culminait à 31,3 milliards d'euros (34,69 milliards de dollars) d'amendes et de règlements, un montant qui n'était pas limité aux Etats-Unis. Même à ce stade, Volkswagen s'attend encore à des sorties de fond jusqu'en 2021.
L'accord de principe pour Daimler devra être confirmé dans les semaines à venir, avec l'approbation finale des autorités et des tribunaux : "L'accord de principe avec les autorités gouvernementales américaines sera consigné dans des décrets de consentement contraignants. Dans les semaines à venir, les autorités déposeront ensuite les décrets de consentement auprès d'un tribunal de district américain pour approbation finale".
