Un dirigeant de Berenberg soupçonné de délit d’initié

La plus ancienne banque allemande a été perquisitionnée à la veille du week-end. L’office national de police criminel soupçonne l’un de ses actionnaires et dirigeants, Hendrik Riehmer, d’un possible délit d’initié survenu il y a deux ans.

C’est un coup de tonnerre dans le monde feutré de la finance allemande. La Banque Berenberg, qui a vu le jour en 1590, et qui est totalement privée, a vu débarquer dans ses bureaux à la veille du week-end des enquêteurs de l'Office national de la police criminelle qui ont fouillé tous ses bureaux à Hambourg. En même temps ils perquisitionnaient deux villas privées et les bureaux d'une société immobilière dans le centre-ville. Ces opérations de police judiciaire ont eu lieu en présence de représentants de l'Autorité fédérale de surveillance financière (Bafin). Officiellement elles sont destinées à fournir des informations sur une – voire des – opérations boursières intervenues en 2017 sur les titres Hapag-Lloyd, qui pourraient violer la loi sur le commerce des valeurs mobilières.
Un porte-parole de la banque a confirmé ces perquisitions en affirmant que la banque coopérait avec les autorités et restait convaincue que la suspicion ne serait pas confirmée. L'enquête n'est pas dirigée contre la banque, mais contre l'un de ses partenaires : Hendrik Riehmer, qui est le numéro deux de la banque aux côtés de Hans-Walter Peters, le patron, et responsable de la banque d'investissement. De plus, un ancien employé de Berenberg, qui dirige une société immobilière, et une femme de son entourage privé se trouveraient parmi les suspects.
Hendrik Riehmer est soupçonné d’avoir communiqué à certaines personnes au début de l’année 2017 que TUI AG, qui détenait encore à l'époque une participation plus importante dans Hapag-Lloyd, allait bientôt vendre ses actions. De sources judiciaires, il se dit qu'il avait des informations d'initié à ce sujet, car Berenberg était impliqué en tant que prestataire de services. Lorsque TUI a annoncé la transaction en juillet et que le cours de l'action a augmenté, plusieurs paquets d'actions précédemment acquis par les deux suspects auraient vu leur valeur s’apprécier de 3,7 millions d'euros en l’espace de 24 heures.
Selon le rapport préliminaire de la justice allemande, un tribunal aurait demandé que la somme de 20 millions d'euros soit saisie sur les comptes des deux accusés. Une telle démarche ne serait possible que s'il y avait suffisamment de soupçons. Toutefois, il ne devrait pas être facile pour la justice de prouver une violation de la loi s’agissant du numéro deux de Berenberg. Car on savait depuis longtemps que TUI avait l'intention de vendre sa participation dans Hapag-Lloyd. En outre, il était probablement loin d'être évident que la sortie d'un actionnaire important entraînerait automatiquement une hausse du cours de l'action Hapag-Lloyd.
