Le poids lourd du PNF Eric Russo passe dans le privé
Le cabinet d’avocats américain Quinn Emanuel Urquhart & Sullivan en France vient de réaliser l’un des gros transferts de l’année : il vient de débaucher Eric Russo, jusqu’ici premier vice-procureur au parquet national financier (PNF).
Le magistrat s’est en particulier distingué dans les affaires UBS, HSBC, Société Générale et Airbus, aux termes desquelles il a obtenu des milliards d’euros d’amendes à travers des procédures amiables (Conventions judiciaire d’intérêt public, ou CJIP), introduites en France en 2016 et inspirées des Etats-Unis, qui permettent aux entreprises d’éviter un procès : 3,7 milliards d’euros (sur un total de 4,5) dans le procès contre UBS pour démarchage bancaire illégal ; 3,6 milliards dans le cadre de l’affaire Airbus (dont 2,1 milliards pour l’Etat français) ; 1,3 milliard vers par la Société Générale aux Etats-Unis et à la France pour solder les affaires de corruption avec le fonds souverain libyen et de la manipulation du taux interbancaire Libor ; et 300 millions contre HSBC Private Bank pour des faits de blanchiment de fraude fiscale – dans ce qui fut la première CJIP en France, fin 2017.
Le recrutement d’Eric Russo remet au premier plan la disparition progressive des barrières entre public et privé. Une tendance de plus en plus fréquente dans le monde de la finance et des affaires en général, qui cherche à recruter des associés ou des conseillers parmi les membres de la haute administration publique ou les membres du gouvernement. Une façon de profiter de leurs carnets d’adresses, supposés bien remplis, mais aussi d’avoir une influence dans l’administration ou les parlementaires, alors que la réglementation nationale comme internationale prend un poids de plus en plus important dans l’économie, en particulier la finance. Pouvoir anticiper et, au besoin, orienter les débats est devenu un sujet stratégique, au grand dam des défenseurs de la neutralité des pouvoirs publics et de son imperméabilité aux intérêts particuliers.
Le sujet est évidemment moins polémique dans les professions du droit. "C'est un mouvement naturel et cohérent, nous devons développer une transversalité dans nos métiers", déclare ainsi un magistrat au quotidien Les Echos, dans lequel le cabinet Quinn Emanuel a choisi de communiquer l'information. En France, la possibilité de fluidifier les parcours entre la magistrature et le barreau est un sujet de revendication. Si le passage du premier au second est aisé - comme le prouve le mouvement d'Eric Russo - les règles permettant aux avocats de devenir magistrats sont plus sévères.
