CumEx files : le Sénat adopte un nouveau dispositif
Le vaste scandale qui a éclaté il y a quelques semaines sur les pratiques d’arbitrage de dividendes, a finalement fait réagir le Sénat. (Pour lire un article complet sur cette affaire, cliquez ici). Il y a moins d’une semaine, le Palais du Luxembourg déjà prévenait qu’il examinait “plusieurs amendements identiques déposés par différents groupes politiques visant à faire échec aux opérations ‘d’arbitrage de dividendes’”.
Et hier soir, les sénateurs ont finalement adopté un dispositif de lutte contre ces opérations permettant à des investisseurs étrangers d’échapper à la taxation de ces sommes par le fisc français, c’est-à-dire la retenue à la source d’un taux de 30 %. Ces mêmes opérations qui coûtent au fisc français un à trois milliards d’euros chaque année. Le Sénat n’a pas encore publié de communiqué à ce sujet, mais d’après des sources proches de Reuters, “les établissements payeurs seront tenus d’adresser au fisc un récapitulatif annuel de l’ensemble des versements effectués dans ce cadre, afin de permettre les contrôles nécessaires”.
Et si ces dispositions sont confirmées dans le texte définitif, “les banques devront par défaut appliquer cette taxation de 30 % aux flux financiers concernés” dès l’an prochain. “Les bénéficiaires de ces flux pourront obtenir un remboursement a posteriori s'ils prouvent que les opérations ont été réalisées en respectant les règles et non dans un objectif d'optimisation ou d'évasion fiscale”. A noter par ailleurs que “le gouvernement ne s'est pas prononcé contre cette disposition et ne l'a pas non plus soutenu, s'en remettant ‘à la sagesse’ des sénateurs”.
Pour rappel, l’arbitrage de dividendes permet aux actionnaires non résidents de sociétés françaises - entre autres - d’échapper à ladite imposition en prêtant directement ou indirectement leurs actions au moment du versement de dividende à une banque française - entre autres - ou à un résident d’un pays lié à la France par une convention fiscale prévoyant une imposition à 0 %. Comme le rappelle le Sénat dans un communiqué en date du 22 novembre, “il s’agit de l’Arabie saoudite, Bahreïn, l’Égypte, les Émirats Arabes Unis, la Finlande, le Koweït, le Liban, Oman et le Qatar”.
